“Russian prison means death for people like me,” said Oleg Mavromatti, a filmmaker and performance artist.

Mavromatti, 45, fled to Bulgaria in 2000 after the Russian Orthodox Church complained about a movie he was shooting in which he is crucified. He was accused of violating a criminal code that includes inciting religious hatred and denigrating the church, an offense punishable by as much as five years in prison.

Last month, the Russian consulate in Sofia refused to renew Mavromatti’s passport.

“They gave me two options,” he said in a telephone interview from his apartment in Sofia. “Either I voluntarily fly to Moscow and stand trial or Interpol comes after me.”

Mavromatti’s case highlights what human-rights activists see as a return to Soviet-style censorship, with a resurgent Russian Orthodox Church playing a central role and the Kremlin supporting it.

Last month, four artworks by Avdei Ter-Oganian were temporarily withheld by Russian authorities from an exhibition at the Louvre Museum in Paris because, a Culture Ministry official said, they incited religious hatred. This summer, two prominent art curators were found guilty of the same crime because several works in the “Forbidden Art” exhibition they organized in 2007 were considered offensive, including a depiction of a Christ figure with a Mickey Mouse head.

“Some people may find a particular work of art offensive or disagreeable, however this cannot be the basis for restricting the right to freedom of expression,” said Denis Krivosheev, a researcher on Russia at Amnesty International in London.

Mavromatti has spent the past decade in Sofia and New York where he regularly showed at Exit Art , a nonprofit exhibition space. In his performance-art pieces, his subjects have included the financial crisis and the war in Iraq.

After Russian authorities released Ter-Oganian’s work, the Prague-based artist announced he wouldn’t participate in the Louvre show unless Mavromatti’s passport is renewed.

In New York, Mavromatti’s backers include U.S. Senator Kirsten Gillibrand , Exit Art director Jeanette Ingberman, art dealer Ronald Feldman and Mark Rothko ’s son Christopher Rothko. All of them have written letters to immigration officials in Bulgaria and to the United Nations High Commissioner for Refugees in support of Mavromatti’s application for the humanitarian-refugee status he would need to enter another country.

After learning on Sept. 11 that Mavromatti’s passport wasn’t renewed, Ingberman called Feldman, who had campaigned on behalf of Soviet dissidents in the 1970s and 1980s.

“It’s a dangerous sign that democracy in Russia is struggling,” Feldman said. He and Ingberman buttonholed Gillibrand at a reception and told the senator about Mavromatti’s plight.

“Time is running out,” said Feldman. “We want to forestall his deportation. We don’t want to fight this battle in Russia.”

Russian artist and filmmaker Oleg Mavromatti currently residing in Sofia (Bulgaria) was refused his passport renewal on the grounds of being charged with "inciting national and religious hatred" under the Section 282 (2) of The Criminal Code of The Russian Federation. If he is not granted political asylum and protected from the extradition, he will face up to five years in jail. We express our deepest concern with regard to the persecution of the Russian artist and ask for your support in consideration of his political asylum appeal.

On April 1, 2000 during the making of the movie “Oil on Canvas”, the movie director Oleg Mavromatti played the role of an artist who killed another artist out of acute jealousy, and wanted to redeem himself from this deed. With his crew and actors, Oleg Mavromatti was shooting the scene of redemption "Do Not Believe The Eyes”. The scene was turned into a performance, during which his hands were nailed to a wooden cross. To distance himself from the famous Gospel, Oleg Mavromatti inscribed on his back "I am Not the Son of God". The situation went out of control when in response to an unauthorized call from some unsuspecting actor, the Russian TV has arrived and made it the news.

Shortly, under the initiative of the pro-Fascist organization "The Union of Orthodox Gonfaloniers”, Oleg Mavromatti was charged with "inciting national and religious hatred". His Moscow apartment was searched, his personal archive, including all art works, films, computers and other electronic media were confiscated. Facing the jail term, Oleg Mavromatti was forced to leave the country.

For the past ten years Oleg Mavromatti lived and worked in Sofia (Bulgaria) and Troy (New York) with his wife, a Bulgarian citizen, artist Boryana Rossa Dragoeva, currently a post-graduate student at the Department of Electronic Arts, at Rensselaer Polytechnic Institute (Troy, New York). While in Bulgaria, Oleg Mavromatti applied for political asylum under the support from the Helsinki Human Rights Group, but was refused. It was brought to his attention, that beginning 1992 Bulgaria does not grant Russian citizens political asylum status.
Similar case was initiated against Russian artist Avdei Ter-Oganian in 1999, who was granted political asylum in Czech Republic.

Recently, the Section 282 (2) was exercised against the Head of Contemporary Art Department at Russian State Tretyakov Gallery, Anderei Erofeev and Director of the Andrey Sakharov Museum and Public Centee, Yuri Samodurov. Both lost their jobs after the beginning of the trial. In July 2010 they were found guilty under the Section 282 (2). The trial was followed closely by Amnesty International, which unequivocally condemned the very possibility of the verdict and accused the Russian justice in violation of the rights and freedoms of Russian citizens.

Oleg Mavromatti - an internationally acclaimed artist and filmmaker, founder of the Supernova Movie Union. On September 8th, 2010 Russian artist Oleg Mavromati, currently living in Bulgaria and the US, was refused renewal of his Russian passport by the Consulate of the Russian Federation in Sofia, on the grounds that Mavromati has been avoiding trial in the Russian Federation for the performance he made in 2000. If he returns to Russia he will be put on trial and faces 3-5 years of prison.

Mavromati was prosecuted for “Do Not Believe Your Eyes” under article 282 of the Criminal Code of Russian Federation with “inciting religious hatred and offending the feelings of religious believers.” A legal complaint from the chairman of the local Orthodox Church community “St. Nikola” against Mavromati was disregarded by the Moscow City court as there was no evidence of crime. Through coercive measures and political connections the same complaint was sent to the General Attorney's office. Then Mavromati’s home was searched and all his video and film materials were confiscated.

“Do Not Believe Your Eyes” was not meant to offend the religious feelings of anyone, or the Orthodox faith in particular. It was also not meant to mock the Christian crucifixion or to represent any religious symbol, but rather to represent an archetype of pain. The performance was a scene of a film directed by Mavromati and called “Oil on Canvas.” Mavromati played the main role, for which he performed the crucifixion. The story was based on the biography of the young Russian painter Oleg Golosiy, who was tragically killed by another artist because of envy. Mavromati was playing the role of the artist who killed Golosiy. The character repented and in order to prove his sincerity he changed the traditional artistic medium he used (oil on canvas) with direct action and physical expression. As a true evidence of his repent the character decided to crucify himself by that representing his personal guilt.

Now there is a new urgent situation: Mavromati was just notified by the Russian Consulate in Sofia that they will not renew his passport. According to the Russian Consulate the passport renewal was refused because Mavromati has been avoiding trial in the Russian Federation for the performance he made in 2000. If he returns to Russia and put on trial Mavromati faces 3-5 years of prison.

Mavromati currently lives in Sofia with his wife, Bulgaria artist Boryana Dragoeva. The couple are internationally exhibited video artists, Boryana is also currently a PhD student at Rensselaer Polytechnic Institute, Troy, NY department of Electronic Arts.

This is not an isolated case. Amnesty International had made a statement about other Russian artists being prosecuted under article 282 :

Rather, they should seek to limit forms of expression which have the potential to cause harm to individuals and which are incompatible with the underlying values of human rights.”

Article 282 (for “inciting religious hatred and offending the feelings of religious believers.” has successfully been used to convict other artists, curators and journalists.
